Terms and Conditions of the Online Store

§ 1 General Provisions

  1. The online store operating at www.evamats.store (hereinafter referred to as the "Store") operates under the terms and conditions set out in these Terms and Conditions.
  2. These Terms and Conditions define in particular:
    • the rules for concluding and terminating Sales Contracts for Products,
    • the complaint handling procedure,
    • the rules for providing electronic services,
    • the types and scope of electronic services provided by the Store,
    • the conditions for concluding and terminating contracts for the provision of electronic services.
  3. Each User, upon taking any action aimed at using the Electronic Services of the Store, is obliged to comply with the provisions of these Terms and Conditions.
  4. Important note for international Customers: The Seller is a Polish limited liability company. By placing an Order, you are entering into a contract with this Polish entity. These Terms and Conditions apply to Customers worldwide, however, where the Customer is a Consumer who is habitually resident in another EU/EEA Member State or in another jurisdiction with mandatory consumer protection rules, the Customer shall benefit from any mandatory provisions of consumer protection law of their country of residence which cannot be derogated from by agreement.

Product Colour Variations

  1. The colours of Products presented on the Store's website are for illustrative purposes only and may differ from the actual colours of the Product.
  2. Such differences may result in particular from:
    • individual settings of monitors and device screens (e.g. brightness, contrast, colour temperature),
    • the type of lighting used when viewing the Product (natural or artificial),
    • the specific characteristics of EVA material, including its structure and texture, which may affect colour perception.
  3. Differences in colour shall not constitute grounds for a complaint, provided that the Product meets all other agreed parameters, including dimensions, workmanship quality and design.
  4. In matters not regulated by these Terms and Conditions, the applicable provisions of European Union law, in particular: Regulation (EU) 2016/679 (GDPR), Directive 2011/83/EU on consumer rights, Directive (EU) 2019/771 on the sale of goods, Regulation (EU) No 524/2013 on online dispute resolution, as well as the laws of the Republic of Poland (as the Seller's country of establishment), shall apply.

§ 2 Definitions

  • TERMS AND CONDITIONS – these Terms and Conditions of the Store.
  • STORE – the online store operated by the Service Provider at www.evamats.store.
  • ELECTRONIC SERVICE – a service provided electronically by the Service Provider to the User via the Store.
  • CONTACT FORM – an electronic form available on the Store's website enabling the User to send a message to the Service Provider.
  • QUOTATION FORM – an electronic form available on the Store's website enabling the User to request an individual quotation.
  • ORDER FORM – an electronic form available on the Store's website enabling the User to place an Order.
  • REVIEW SYSTEM – an Electronic Service provided by the Service Provider enabling Customers to post opinions and reviews about Products.
  • NEWSLETTER – an Electronic Service enabling the User to subscribe to and receive free commercial information about Products available in the Store, sent by the Seller to the e-mail address provided by the User.
  • SELLER/SERVICE PROVIDEREVAMATS Sp. z o.o., a limited liability company established under the laws of the Republic of Poland, with its registered office at ul.   • USER – a natural person, legal person or organisational unit with legal capacity, using Electronic Services provided by the Service Provider.
  • CUSTOMER – a User who intends to conclude or has concluded a Sales Contract with the Seller.
  • CONSUMER – a natural person acting for purposes outside his or her trade, business or profession, within the meaning of EU consumer protection law.
  • BUSINESS CUSTOMER – a natural or legal person acting in the course of its trade, business or profession.
  • PRODUCT – a movable item or service available in the Store and being the subject of a Sales Contract concluded between the Customer and the Seller.
  • SALES CONTRACT – a contract for the sale of a Product concluded between the Customer and the Seller via the Store.
  • ORDER – a declaration of intent submitted by the Customer via the Store, constituting an offer to conclude a Sales Contract.
  • PRICE – the monetary value the Customer is obliged to pay to the Seller for the Product.
  • DISCOUNT CODE – an alphanumeric string made available by the Seller, entitling the Customer to a reduction in the Price of a Product or Order on the terms set out in § 4 of these Terms and Conditions.

§ 3 Information About Products and Ordering Process

  1. The Store operating at www.evamats.store sells Products via the Internet.
  2. All Products offered in the Store are new, manufactured individually upon the Customer's order and according to the specifications selected by the Customer, are compliant with the Sales Contract and have been lawfully placed on the European Union market.
  3. Information provided on the Store's website does not constitute an offer within the meaning of applicable law. By placing an Order, the Customer submits an offer to purchase a specific Product under the conditions described in its description.
  4. The Product price displayed on the Store's website is expressed in the currency selected by the Customer or determined by the Customer's geographic location (typically EUR; alternative currencies may be available depending on the destination market). All prices include applicable VAT/sales tax unless expressly stated otherwise. Prices do not include delivery costs, which are calculated at checkout.
  5. The Product price displayed on the Store's website is binding at the moment the Customer places the Order and shall not change regardless of any later price changes in the Store that may apply to individual Products after the Order has been placed.
  6. The Seller clearly informs Customers about unit prices, promotions and price reductions. In the case of a price reduction, the Seller also displays the lowest price of the Product that applied during the 30 days prior to the introduction of the reduction, and if the Product has been offered for sale for a period shorter than 30 days, the lowest price applicable from the beginning of its offering until the introduction of the reduction, in accordance with EU consumer protection law.
  7. Orders may be placed:
    • via the Store's website using the Order Form (www.evamats.store) – 24 hours a day, all year round,
    • by e-mail at: info@evamats.store,
    • via the Quotation Form,
    • by telephone or SMS (charges apply according to the Customer's network operator),
    • via social media platforms, including Facebook, Messenger, Instagram, TikTok and WhatsApp.
  8. A condition for placing an Order in the Store is that the Customer reads and accepts these Terms and Conditions at the time of placing the Order.
  9. Promotional (sale) Products are available in limited quantities, and Orders for such Products are processed in the order in which they are received, until stocks are exhausted.

Prohibited actions and improper use of EVA mats

  1. In order to ensure long-term usability and to prevent damage to EVA mats, the following rules must be observed:
    • Avoid contact with sharp objects: Do not use sharp tools such as knives, scissors, or footwear with sharp edges (e.g. high heels), which may puncture or cut the mat structure.
    • Do not use pressure washers at close range: When cleaning EVA mats with a pressure washer, maintain a minimum distance of 20 cm between the nozzle and the surface of the mat. Using the washer at a closer distance may damage the material.
    • Avoid exposure to extreme temperatures: Do not expose EVA mats to direct high heat sources (e.g. heaters, heat guns). EVA material is resistant to low temperatures but may deform when exposed to temperatures exceeding 80°C.
    • Do not use hard brushes or abrasive tools: Medium-stiffness brushes may be used. Tools with sharp edges or abrasive surfaces that may mechanically damage the mat surface must be avoided.
    • Do not modify or cut the mats: EVA mats are designed and manufactured according to the vehicle's specifications. Any self-made modifications, such as cutting or perforating, may result in damage to the Product and void the warranty.

Gift Cards

  1. The Store offers digital gift cards (e-Gift Cards) available for purchase via the Store's website. Gift cards are issued in electronic form and delivered to the e-mail address provided by the purchaser.
  2. Validity period: All gift cards purchased in the Store are valid for 12 months (1 year) from the date of purchase. After this period, the gift card expires and cannot be redeemed.
  3. Gift cards can be used as payment (or partial payment) for any Product available in the Store, subject to the value remaining on the card.
  4. Gift cards are non-refundable and cannot be exchanged for cash. Any unused balance after a purchase remains on the card and may be used until the expiry date.
  5. The Seller is not responsible for lost, stolen or misused gift cards. The gift card code is treated as cash equivalent and should be kept securely.
  6. In case of return of a Product purchased (fully or partially) with a gift card, the refund will be issued in the form of store credit or a new gift card with corresponding value and validity period, in accordance with the original payment method.

§ 4 Discount Codes and Promotions

  1. The Seller may make discount codes (hereinafter referred to as "Discount Codes") available to Customers, entitling them to a reduction in the Price of a Product on the terms specified by the Seller on each occasion.
  2. A Discount Code may be single-use or multi-use, fixed-amount or percentage-based, generally available or individual (assigned to a specific Customer or e-mail address), and may also be limited by a validity period, a minimum Order value, or a specific range of Products.
  3. Within a single Order, the Customer may use a maximum of 3 (three) Discount Codes. An attempt to apply a greater number of Discount Codes shall have no legal effect with respect to the excess over this limit, regardless of whether the Store's IT system technically allowed them to be entered.
  4. Discount Codes do not combine with other promotions, reductions, sales, or rebates in force in the Store, unless the terms of a given promotion expressly state otherwise. Where several discounts apply simultaneously, the Customer may use the option most favourable to them.
  5. Discount Codes are not exchangeable for cash or for any other benefit. Any unused portion of the value of a Discount Code is not subject to refund.
  6. Discount Codes do not cover delivery costs, unless their detailed terms state otherwise.
  7. In the event that, due to a technical error, system failure, unauthorised use, or another cause beyond the Seller's control, more than 3 (three) Discount Codes are used within a single Order, or Discount Codes are applied contrary to the rules set out in this paragraph, the Seller is entitled to:
    • contact the Customer in order to correct the value of the Order and establish the correct Price in accordance with the provisions of these Terms and Conditions,
    • cancel the excess Discount Codes, retaining a maximum of 3 (three) that are most favourable to the Customer,
    • withdraw from the Sales Contract within 5 business days from the date of its conclusion, in the event that the Customer does not accept the corrected value of the Order; in such a case, the Seller shall promptly refund to the Customer all payments made by them.
  8. The provisions of point 7 do not affect the rights of the Consumer arising from mandatory provisions of law, in particular EU consumer protection law.
  9. The Seller reserves the right to invalidate a Discount Code in the event of its use contrary to its intended purpose, in particular in the case of attempts to circumvent the limit specified in point 3, use of a Discount Code by an unauthorised person, or use in a manner bearing the hallmarks of abuse of rights.
  10. The detailed terms of individual Discount Codes (validity period, minimum Order value, product exclusions, and others) are indicated by the Seller each time a given Discount Code is made available.

§ 5 Conclusion of the Sales Contract

  1. The conclusion of a Sales Contract requires the Customer to place an Order in advance using one of the methods made available by the Seller, in accordance with the Terms and Conditions.
  2. After an Order has been placed, the Seller shall promptly confirm its receipt.
  3. Subject to specific exceptions, the confirmation of receipt of the Order results in the Customer being bound by the submitted Order. Confirmation of receipt of the Order may be provided by telephone, e-mail, SMS, or via social media platforms including Facebook, Instagram, TikTok and WhatsApp.
  4. In the case of placing an Order by email or Quotation Form, the Sales Contract is concluded at the moment the Customer accepts the offer sent by the Seller in response to the Customer's enquiry.
  5. The confirmation of receipt of the Order includes: confirmation of all essential elements of the Order, a withdrawal from the contract form, and these Terms and Conditions, including information on the right of withdrawal.
  6. Upon receipt by the Customer of the e-mail message, a Sales Contract is concluded between the Customer and the Seller.

Proof of Purchase

  1. Each Sales Contract shall be confirmed by a proof of purchase, which shall be enclosed with the Product and/or sent electronically to the e-mail address provided by the Customer in the Order Form.
  2. The Customer agrees to receive the proof of purchase in the form of an electronic receipt.

Commencement of Order Fulfilment

  1. The Seller shall commence the fulfilment of the Order only after the Customer has: provided all necessary information regarding the vehicle and the ordered Product, provided photographs of the vehicle floor for which the Product is ordered if requested, and paid the required advance payment or the full Product price.
  2. The Customer is obliged to fulfil these obligations within 5 business days from the conclusion of the Sales Contract (extended to 7 business days for international bank transfers from outside the SEPA area). Failure to do so entitles the Seller to withdraw from the Sales Contract.
  3. The Seller shall commence cutting and processing of materials for the Product only after receiving the advance payment or the full Product price.

§ 6 Payment Methods

  1. The Seller provides the Customer with the following payment methods:
    • payment by traditional bank transfer to the Seller's bank account,
    • payment via an electronic payment system (Stripe, Apple Pay, Google Pay, PayPal, Shopify Payments) or by payment card through the respective payment service provider.
  2. In the case of payment by traditional bank transfer, the payment shall be made to the following bank account:

    International customers outside the SEPA area should consider using online payment methods to avoid international bank transfer fees and delays.
  3. The Customer is required to include the Order number, e-mail address, and vehicle make and model in the transfer title.
  4. The Seller's payment system also enables Customers to make payments by payment card.
  5. For Customers who are entrepreneurs, the Seller reserves the right to limit the available payment methods, including requiring full or partial prepayment, regardless of the payment method chosen by the Customer or the conclusion of the Sales Contract.
  6. If the Customer does not make payment within 5 business days (or 7 business days for international transfers from outside SEPA), the Seller may withdraw from the Sales Contract.

§ 7 Applicable Law and Jurisdiction

  1. These Terms and Conditions and any Sales Contract concluded under them are governed by the law of the Republic of Poland, with the following important exception:

Where the Customer is a Consumer who is habitually resident in another EU/EEA Member State, the Customer shall, in addition to the protection provided by Polish law, also benefit from the mandatory provisions of consumer protection law in their country of habitual residence which cannot be derogated from by agreement (in accordance with Article 6 of Regulation EC 593/2008 — Rome I).
  3. Where the Customer is a Consumer outside the EU/EEA, the application of mandatory consumer protection laws of the Customer's country of residence shall prevail over these Terms where required by such law.
  4. Disputes arising from these Terms shall be subject to the jurisdiction of competent Polish courts. However, Consumers retain the right under Article 18 of Regulation EU 1215/2012 (Brussels I bis) to bring proceedings in the courts of their country of residence and may only be sued in those courts.

§ 8 Out-of-Court Dispute Resolution (ADR)

  1. The Seller is committed to resolving disputes amicably and through direct communication with the Customer.
  2. The European Commission provides an Online Dispute Resolution (ODR) platform accessible at: ec.europa.eu/consumers/odr. Consumers in the EU may use this platform to find competent national ADR bodies and submit complaints.

§ 9 Final Provisions

  1. These Terms and Conditions are valid from the date of publication on the Store's website.
  2. The Seller reserves the right to amend these Terms and Conditions for important reasons, including changes in applicable law. Such amendments shall not apply to Orders placed before the amendments come into force.
  3. Should any provision of these Terms and Conditions be found invalid, this shall not affect the validity of the remaining provisions.
